Peter Singer asienta su noción de “persona” en las cualidades que exhibe un individuo, negando la dignidad de la persona a un individuo por el simple hecho de pertenecer a la especie humana. Por ello, acusa de “especistas” a quienes reservan la categoría de personas a todos los seres humanos y se la niegan a los miembros de otras especies biológicas, aunque exhiban algún tipo de racionalidad. Para examinar esta propuesta se parte de la definición de persona de Summa Theologiae (...) I, q. 29, a 1. Los argumentos que, contra la tesis de Singer, avalan esta noción tomista se fundamentan en las convicciones del sentido común a las que explícitamente ha recu-rrido la Ética desde antiguo para justificar sus teorías. Mostramos en qué acierta, en qué se equi-voca y por qué se equivoca Singer. (shrink)

En primer lugar explicitaré que el modo en que tiende a plantearse hoy la relación entre naturaleza y virtud es el de las relaciones entre naturaleza y cultura. Haré ver al mismo tiempo la importancia de esta cuestión en el momento histórico que nos toca vivir. El resto del trabajo intenta encontrar una respuesta aristotélica satisfactoria a las interrela-ciones entre naturaleza y cultura que evite las dificultades y aporías en que incurre el planteamiento corriente. Para ello recuperaremos tanto una noción (...) de naturaleza diferente a la habitual como un concepto perfilado de virtud, ambos basados en Aristóteles. Termina-remos nuestra exposición discutiendo en qué sentido y hasta qué punto naturaleza y virtud son mundos incomunicados o que se reclaman mutuamente. (shrink)

The article elucidates the concept of subjectivity in Karl Marx, while providing an analysis from a Heideggerian and a Foucaultian perspective. Furthermore, the aim of the article is to determine the relevance of the categories elaborated by Heidegger and Foucault in the analysis of the Marxist concept of subjectivity. In order to achieve this goal, the article is divided into three sections. First, the concept of subjectivity is studied as it appears in Marx’s works. Second, a Heideggerian reading of that (...) concept is reconstructed from elements of the “early” and “later” Heidegger. Third, a Foucaultian reading of subjectivity is proposed from the coordinates of the notions of governmentality, veridiction and subjectivation. It is concluded that the readings of Heidegger and Foucault are, respectively, insufficient and partially sufficient, which does not exclude, however, the possibility of adding nuances to them in order to develop, with contributions from all three philosophers, a kind of “post-Heideggerian and post-Foucaultian Marxism”. Linguistics of saying studies language in its birth. Language is the mental activity executed by speaking subjects. Linguistics of saying consists in analyzing speech acts as the result of an act of knowing. Speaking subjects, speak because they have something to say; they say something because they define themselves before the circumstance they are in; and this is possible because they are able to know. Speaking, then, is speaking, saying and knowing. In this sense there is a progressive determination. Knowing (...) makes possible saying, and saying determines speaking. The problem thus is to determine the linguistic intention of the individual speaker to say something in every speech act. (shrink)

This article aims to analyze the concept of animality from the perspective of Edmund Husserl and Martin Heidegger. More precisely, the question arises as to whether the animal possesses the status of otherness or lacks it. Indeed, the animal, with respect to the human, turns out to be another entity, but, from the assumptions of phenomenology, is that enough for it to be apprehended as an intersubjectivity or a coexistence that is donated to the world of human beings? To answer (...) this question, we will review Husserl's argumentation, especially in Hua IV and Hua XXXIX, and Heidegger's in GA 2 and GA 29/30. Finally, we will add a critical consideration of the ideas of the authors studied in the face of developments in contemporary biology to ask ourselves to what extent their philosophical inquiry would be consistent with current zoological evidence. Although US and European research has documented improvement in earnings quality associated with corporate governance characteristics, the situation in Latin America is questionable, given the business environment in which firms operate, which is characterized by controlling family ownership and weak legal protection. The purpose of this study is to examine the relation between the internal mechanisms of Corporate Governance and Earnings Management measured by discretionary accrual. We use a sample of listed Latin American non-financial companies from the period 2006–2009. Our (...) results show how in the Latin American context the role of external directors is limited and that Boards which meet more frequently take a more active position in the monitoring of insiders, so showing a lower use of manipulative practices. In addition, we find a non-linear relation between insider ownership and discretionary accruals, also pointing to the fact that ownership concentration may be a manipulative practices constrictor mechanism only when the ownership of main shareholders is moderate. The findings have important policy implications since this is, to the best of our knowledge, the first study to analyze the relation between the effectiveness of the government and the earnings management behavior. As policy implications, we document how when a country implements controls aimed at reducing corruption, strengthening the rule of law or improving the effectiveness of government, this leads to a reduction in firm earnings management. The assumption in current U.S. mainstream medicine is that birthing requires hospitalization. In fact, while the American College of Obstetricians and Gynecologists supports the right of every birthing person to make a medically informed decision about their delivery, they do not recommend home birth owing to data indicating greater neonatal morbidity and mortality. In this article, we examine the evidence surrounding home birth in the United States and its current limitations, as well as the ethical considerations around birth setting.

El decir es anterior y va más allá del hablar, se vale del hablar y constituye la determinación del hablar. No hay un hablar sin un decir y sí puede haber un decir sin un hablar. El acto lingüístico es la manifestación del lenguaje, la lengua, el pensamiento y el conocimiento. Es fruto de un hablar, está determinado por un decir, presupone un conocer y revela la actitud del hablante, un sujeto libre e histórico, que es, a la vez, sujeto (...) hablante, dicente y cognoscente, ante la realidad y el mundo. De la misma manera que no se da un hablar sin un decir, tampoco se da un decir sin un conocer. En su génesis más profunda el conocer determina al decir y éste al hablar. Así, pues, el «ser hablante» (Coseriu) es, a la vez, el sujeto «dicente» (Ortega y Gasset) y el sujeto cognoscente (Coseriu, Ortega y Gasset, Heidegger, Aristóteles), porque se realiza a sí mismo en el acto del hablar y éste está determinado por el acto del decir y en última instancia por el acto del conocer. El decir define al hablante ante la realidad y el mundo y da soporte a lo que es la realidad y el mundo, que no es más que aquello a lo que el sujeto hablante, dicente y cognoscente le atribuye el ser o realidad. El ser humano, «coexistencia actuante de mí o yo con la circunstancia o mundo» (Ortega y Gasset), se libera de la necesidad vital en la que está inmerso, de la circunstancia a la que está inexorablemente ligado, mediante el conocer. Por el conocer el ser humano atribuye a eso que le rodea y afecta «el ser», haciendo de ello «cosas» y «mundo» constituido por «cosas». Todo esto se manifiesta en el acto lingüístico, que es un acto creador en un triple sentido: crea las cosas y el mundo (contenidos de conciencia, significados), crea la realidad de las cosas y el mundo, y crea la expresión de lo que es las cosas y el mundo (el lenguaje y la lengua) mediante lo dicho (lektón) determinado esto por el pensamiento (lógos). El acto lingüístico es creación (poiesis) y es manifestación (apóphansis), acto de crear un mundo y acto de desvelar el mundo interior del sujeto hablante, dicente y cognoscente, acto de desvelar lo que está oculto y que ahora es no-oculto o verdadero (a-lethés). El hablar, el decir y el conocer son acciones vitales del ser humano. El hablar es una acción vital del sujeto creador que le viene de fuera, de la comunidad; el decir es la acción vital que le viene de dentro y que proyecta él mismo hacia fuera, hacia la comunidad; y el conocer es el acto mismo de creación de un sujeto, que es, opuestamente, libre e histórico, absoluto y limitado, creador de formas y participante de formas comunes creadas en la comunidad. El hablar en sí mismo, al igual que la lengua, es a-circunstancial y tiene que ver con la creación en términos absolutos e históricos. El decir como manifestación del interior del sujeto hablante, dicente y cognoscente tiene que ver con la verdad o aquello que se manifiesta desvelándose (a-létheia). De esta manera, podemos ver dos clases de pensamiento o logos: el logos a-circunstancial o intersubjetivo o histórico, lógos semantikós, y el logos que manifiesta una realidad interior y crea una realidad exterior desde el interior del sujeto creador o lógos apophantikós. La lingüística del decir que ahora se presenta recoge una propuesta en el mismo sentido hecha por Ortega y Gasset y es la continuación de la lingüística del hablar de Coseriu. Hace un replanteamiento de la realidad radical, el ser hablante de Coseriu, que es concebido ahora como el sujeto hablante, dicente y cognoscente. Estudia el acto lingüístico, acto del hablar, decir y conocer, como la manifestación primera de la intención significativa de cada sujeto. Se basa en los principios de la lingüística del hablar de Coseriu, especialmente en los que describen el plano universal e individual del hablar, es decir, los principios de la confianza en el hablar del otro y de la congruencia y coherencia en el hablar. Mira, por consiguiente, al acto lingüístico como «producción», como aquello que se crea en el acto único del hablar, decir y conocer. La finalidad de la lingüística del decir es llegar la génesis misma del lenguaje, que no es más que la génesis del acto lingüístico. Analiza el acto lingüístico como la manifestación del acto del conocer, el cual partiendo de la aísthesis o intuición sensible (Ortega y Gasset, Heidegger, Aristóteles) o intuición inédita del hablante (Coseriu), se descompone en una serie de operaciones intelectivas, cada una de las cuales contribuye a configurar de una manera dada la «aprehensión del ser» inicial e inédita. Estas operaciones intelectivas son: la selección, el establecimiento de una designación, la creación de una clase o esencia, la relación, la nominación y la determinación. Tras la presentación y justificación de lo que es cada uno de los conceptos indicados arriba (los cuatro primeros capítulos), el libro dedica un capítulo a cada una de estas operaciones intelectivas, analizada e ilustrada con ejemplos. Como ilustración de lo que puede ser el análisis aquí propugnado, se dedica un capítulo al análisis del adjetivo 'brisk’, adjetivo de conducta de la lengua inglesa. (shrink)

At the confluence between Modern Olympism and Confucian teachings—nowadays embodied and expressed in East Asian Confucianisms—there are meaningful overlaps, significant challenges, and opportunities. This paper examines these. Despite radically different origins and apparently incommensurate tenets, we should not assume that the underlying ideals of Modern Olympism and East Asian Confucianisms cannot benefit mutually. It is precisely when considering their putative weak points, such as Modern Olympism's soft metaphysics or vague ethics or Confucianism's bias against physical activity or gender, that we (...) find educational opportunities that make contributions to a universal humanistic sport education. Los científicos tratan de persuadir a sus colegas y, en última instancia, al conjunto de la sociedad, para que acepten sus tesis, descubrimientos y propuestas. Desarrollan para ello una serie de estrategias que pueden ser estudiadas como un"juego de persuasión" en el que intervienen, además de los procesos de argumentación formal e informal típicamente estudiados por la lógica y metodología de la ciencia, aspectos tradicionalmente considerados "sociológicos". En este artículo se analiza el debate sobre la ciencia del cambio climático como (...) un juego de este tipo, desde un enfoque inferencialista, sobre la base del esquema presentado en Zamora Bonilla (2006a).Scientists try to persuade their colleagues, and ultimately the whole society, of the acceptability of their claims, discoveries and proposals. In order to reach that goal, they develop a number of strategies that can be studied as a 'game of persuasion', in which, beside the processes of formal and informal argumentation typically studied by logic and methodology of science, there are also 'sociological' aspects intervening. This paper analyses the debate on climate change science as a 'persuasion game', from an inferentialist point of view, according to the lines of Zamora Bonilla (2006a). (shrink)

Underperformance under stress is common in many activities such as the arts and academic performance, but examples are particularly evident in sport's "choking" effect—a failure to perform to levels already achieved when the person tries to be at his or her best. Rory McIlroy "disintegrated" at the 2011 U.S. Masters, while Greg Norman epically lost in 1996. On the other end of the spectrum, Mark Spitz and Michael Phelps thrived under media pressure to deliver record-breaking performances at the Olympics. The (...) first set of scenarios showcases athletes failing under pressure. The second presents superb performers who excel when "on the spot." As a way to supplement current psychological and cognitive theoretical research, Dr. Jesús Ilundáin-Agurruza discusses an alternative philosophical account to combat choking. It diagnoses the process and contrasts it with cases of superior performances analyzed under "skillful fluency." The solution is derived from Japanese do—arts of self-cultivation, such as the way of archery or the way of tea—which encourage an integration of body-mind and intellect-emotion that indirectly achieves skillful fluency and avoids choking. Using the approach known as ‘Economics of Scientific Knowledge’, this paper defends the view of scientific norms as the result of a ‘social contract’, i.e., as an equilibrium in the game of selecting the norms under which to proceed to play the game of scientific research and publication. A categorisation of the relevant types of scientific norms is offered, as well as a discussion about the incentives of the researchers in choosing some or other alternative rules.

In this paper I want to present the guiding lines of a research programme into the economics of scientific knowledge, a programme whose ultimate goal is to develop what I would like to call a contractarian epistemology. The structure of the paper is as follows: in the first section I will comment on two conflicting approaches to the topic of rationality in science: the view of the rationality of scientific knowledge as deriving from the employment of sound methodological norms, and (...) the view of scientists as rational agents pursuing the optimisation of their own personal and professional interests. In section 2 I will try to make both approaches mutually consistent by showing that a competition among rational "recognition-seekers" is only possible if they agree in accepting some system of methodological norms. Section 3 will be devoted to analyse the main kinds and properties of these norms. Finally, in section 4 I will discuss a question which is far from being easy and innocent: why are scientific norms obeyed by researchers, once they have been established in a scientific discipline? We give a presentation of Post algebras of ordern+1 (n1) asn+1 bounded Wajsberg algebras with an additional constant, and we show that a Wajsberg algebra admits a P-algebra reduct if and only if it isn+1 bounded.

Our aim in this paper is to throw some light on the kind of normativity characteristic of human knowledge. We describe the epistemic normative domain as that field of human agency defined by knowledge understood as an achievement. The normativity of knowledge rests on the contribution of the epistemic agent to the fulfillment of certain tasks. Such contribution is epistemically significant when the agent becomes engaged in the obtaining of success. Finally, we identify some features associated with full epistemic agency (...) and elucidate what we mean by engagement by appealing to the idea of adopting an epistemic perspective. En este artículo pretendemos arrojar luz sobre la normatividad propia del conocimiento humano. Describimos el dominio normativo epistémico como un campo de agencia humana que está definido por el conocimiento entendido como logro. La normatividad del conocimiento se apoya en la contribución del agente epistémico a la consecución de ciertas tareas. Tal contribución es epistémicamente significativa cuando el agente llega a participar en la consecución del éxito. Por último identificamos algunos rasgos asociados con la agencia epistémica completa, y aclaramos lo que queremos decir con implicación apelando a la idea de adoptar una perspectiva epistémica. Durante la larga vida del escritor y pensador Miguel de Unamuno, hubo dos labores que nunca dejó delado: su trabajo como educador y su vida de escritor. Ambas partes fundamentales de su pensamiento ya que las entiende como centrales para comprender el misterio de la particularidad existencial del hombre de carne y hueso. El presente trabajo tiene como objetivo el análisis a profundidad de dos temas principales: la labor de la educación y el trabajo de escritura en el pensamiento del (...) pensador vasco. Para este análisis se investigó a profundidad la obra escritural del vasco universal, tomando en cuenta que el grueso de sus ideas entorno a la educación y a la escritura se encuentran contenidas tanto en su obra poética como en su correspondencia. Así mismo, se utilizaron trabajos periféricos de autores especialistas en Unamuno y su pensamiento para complementar las ideas. Mediante la investigación, fue posible mapear las ideas del pensador vasco para llegar a una de las ideas centrales de su pensamiento: Tanto el educador como el escritor tan solo pueden ensañar lo que ellos mismos son, es por ello por lo que su labor no es otra que la de poetizar la vida, abriéndose paso a través del lenguaje, narrándose a uno mismo y ayudando a otros a encontrar su voz. El paradigma tradicional en el sistema de patentes se basaba en que solo eran patentables las invenciones, lo que indirectamente excluía la materia viva. Sin embargo, la irrupción de la biotecnología en la propiedad industrial ha supuesto un sustancial vuelco en estas premisas, debido, entre otros factores, a que los seres vivos presentan una naturaleza dual, ya que son al mismo tiempo materia viva e información. Además, la aceleración de las investigaciones en lo referente a la biología sintética y a (...) la inteligencia artificial añade una complejidad creciente a nuestra temática. Pues bien, para analizar los problemas que genera la propiedad privada en lo referente a la vida, hemos creado un modelo con tres pares de variables, invención/ descubrimiento, materia/información, y materia inerte/viva. El objetivo último es clarificar las narrativas que subyacen tras los numerosos documentos que tratan de encauzar, regular y/o refutar las biopatentes. (shrink)

Two aspects of Miranda Fricker’s book are criticised: the implicit assumption that ethical theory can solve fundamental problems in epistemology, and the excessive reliance on testimony as a fundamental source of knowledge. Against the former, it is argued that ethical theories are based on cultural prejudices to a higher extent than epistemological theories. Against the latter, argumentation is proposed as a more important epistemic practice than testimony.

Despite his wide-ranging and incisive engagement with Heidegger's thought across his career, Derrida seems to have written very little about Heidegger's Ereignis manuscripts, which, according to many commentators, constitute the place where Heidegger's thinking comes closest to Derridean deconstruction. Taking up Derrida's comments in Hospitality 1 on the figure of ‘selfhood’ in Heidegger's Contributions to Philosophy, this essay argues that this dense but important moment of engagement with the Ereignis manuscripts reveals the extent to which Heidegger's thinking of selfhood, in (...) spite of its fundamentally relational character, remains thoroughly determined by ipseity, the philosopheme that links selfhood, possibility, and sovereignty within the metaphysics of presence. Beginning with a reconstruction of the link between power and selfhood in Derrida's thinking of ipseity and a close-reading of the key passage in Hospitality 1, the essay then turns to Heidegger's engagement with Hölderlin to show both the depth of Heidegger's commitment to a relational thinking of selfhood and the philosophical and rhetorical safeguards by which he ensures that the relations of difference that constitute the self continue to function in the name of the ipseity, understood as the very Ur-form of sovereign power.
